undertherecommendationoftheNationalEnergyPolicyCouncil,
shallhavethepowertoissuetheMaterialRegulationsasfollows:
(1)Todesignatemachineryorequipmentashavinghigh
efficiency,accordingtothetypesandsizesofthemachineryand
equipment,thequantitiesofenergyconsumption,therateofenergy
loss,andtheefficiencyinenergyconsumption.
(2)Todeterminewhichmaterials,bytypes,qualities,and
standards,arematerialsusedforenergyconservation.
Producersanddistributorsofhigh-efficiencymachineryor
equipment,ormaterialstobeusedforenergyconservationunder
Clauseonehereof,shallhavetherighttoaskforsupportand
assistanceunderSection40.(ECPActB.E.2535)

Theproducerordistributorofhighefficiencymachineryor
equipment,ormaterialstobeusedintheenergyconservation
programmesshallhavetherighttorequestforpromotionand
assistanceasfollows:
(1)exemptionfrompayingsurchargesunderthisAct;
(2)grantorsubsidyfromtheFundunderSection25.
Ownersoffactories,buildings,orgovernmentagenciesand
stateenterpriseswhicharenotrequiredtohaveenergy
conservationprogrammesunderClauseonehereof,butdesire
tomakeprovisionsforenergyconservationpurpose,shall
havetherighttorequestforpromotionandassistanceunder
Clauseonehereof.(ECPActB.E.2535)
