第二条 工程承包范围 Scope of Construction

第四条 工程设计 Article Four Project Design
发包方责任 Employer’s Responsibilities
1、发包方负责本工程基础土建的设计。
Design of civil work of project foundation shall be onemployer.
2、发包方委托承包方承担钢结构部分的设计，发包方提供设计所需要的工艺条件及技术条件（详见第一条工程技术条件）并在本合同生效后三天内提供全部相关的技术条件和工艺条件，以供承包方进行设计。
Employer shall commission contractor to assume the design of steelstructure, for which employer provide the conditions of craftworkand technique which are necessary to design (dialed reference madeto TECHNICAL CONDITIONS OF PROJECT of Article One), in addition tothe provisions of all technical conditions and craftworksconditions, within three days upon validity of this contract forcontractor’s design.
承包方责任 Contractor’s Responsibilities
1、承包方必须按现行国家钢结构相关规范和发包方提供的相关资料及技术条件进行设计，发包方的超规范要求必须书面告之，承包方在国家规范允许的范围内给予适当倾向量。
Contractor should process the design in accordance with State’srelevant norms of steel structure and respected materials andtechnical conditions, if and to the extent that any requirement byemployer beyond state’s norms should be given the prior notice tocontractor which may make appropriate amount of tendency withinallowable arrange of State’s norms.
2、基础图由承包方设计，发包方提供全部相关资料及技术条件后___天内，由承包方提供有资质设计院图签的土建基础施工图 套。
Foundation drawings shall be designed by contractor which should,after days of employer’s provision of all relevant materials andtechnical conditions, provide sets of foundation drawings of civilconstruction，which have been approved / signed by the qualifiedDesign Institute，to employer.
第五条 工地代表责任 Article Five Responsibilities of SiteRepresentative
发包方驻工地代表 Employer’s site representative
1、发包方任命的驻工地代表及其委托代理人由具体管理人员担任，并代表发包方签发有关工程联系单、验收单、结算付款单等。经该代表签署的所有单据具有法律效力，但与本合同条款相冲突的签单无效，以本合同条款为准。
The duties of site representative appointed by and deputy of partyA will be assumed by specific managers who shall issue, by or onbehalf of employer, relevant Project Connecting Letter, AcceptanceNotice and Settlement / Payment Notice, and so on. All documentswhich issued by such representative shall be in full force andeffect, provided that any signed statement by representativeconflict to the stipulations hereof shall be null and void, theterms hereof shall prevail.
2、发包方代表或委托代理人的指令、联系单、通知、须经其本人签名，并以书面形式递交承包方代表，承包方代表在回执上签署姓名、时间后方生效。
No any direction, connecting letter and notice, which are given bysite representative appointed by and deputy of party A, shall comeinto force and effect until have been made the signature of therepresentative thereon and submit in writing to contractor’srepresentative who sign its name on return receipt thereof.
第六条 施工准备 Article Six Execution Preparation
承包方 By Contractor
1、在本合同生效后______日内，由承包方向发包方提供设计图纸______套，并通知发包方组织设计会审和施工图交底会议，会后______日内，由发包方提出修改决定，交承包方修改设计，如有设计变更的，则工期视变更情况作相应调整，增减的工程量按报价单计算作相应调整并另签补充合同。
Contractor will, within days after contract coming into force andeffect, submit sets of design drawings to employer and a notice forthe meeting of joint exam on design and execution drawings. Withindays after the meeting, employer shall issue its amendment decisionfor contractor’s amendment of design. If and to the extension thatmodification or variation of design made, extension of executiontime shall be adjusted correspondingly as the case may be, and alladded or minus quantity shall, calculating on Statement ofQuotation, be adjusted in addition to complementary contractherewith.
3、组织原材料采购制造加工，组织施工管理人员和施工机械进场。

发包方 Employer
1、合同约定委托承包方设计的项目，在本合同签订的同时，由发包方提供本合同规定的资料及技术条件，供承包方设计，在设计完成后有义务书面确认设计。
With respect to the design item done by contractor commissioned bycontract stipulation, employer should, at the same time of thiscontract conclusion, supply the material and technical conditions,which are stipulated hereby, to contractor for the necessity todesign, and have the responsibility of written confirmation on thefinished design by contractor.
2、在承包方进场前做好本工程符合钢结构安装要求的混凝土基础及预埋螺栓并验收合格，同时提供全套土建竣工资料及发包方验收数据的结论。
Employer should, before contractor enter into the site, completeconcrete foundation and embedded bolt for this project, which meetthe requirements for installation of steel structure, and throughacceptance, at same time submit a full set of documents oncompletion of civil engineering project , and conclusion of datainformation from employer acceptance.
3、在承包方进场前，保证本工程施工所需各类车辆进出道路的畅通，接通施工现场的施工用水及照明和动力电源（包括水表、配电板、电表）。
Employer should, before contractor enter into site, ensure the roadon which all types of vehicles necessary for project executionsmooth and free; and make connection of supply of , on site, waterfor execution and electricity for lighting and power (includingwater meter, power distribution panel and power meter).
4、开工前办理建筑许可证等。如因无建筑许可证而发生的相关责任和一切费用由发包方承担。
Employer should, prior to commencement, process with ConstructionLicence and other permissions, if, in the absence of ConstructionLicence, any relevant responsibility and cost arising there fromshall be taken by employer.
第七条 工程期限 Article Seven Project Term
一、本工程钢结构工期自合同签字发包方付达定金之日起_____内完成。其中设计____天,制造_____天,安装自进场起_____天完工。
The project construction should be completed within days as of thedate on which earnest money paid by employer making its signatureon this contract. days of the construction term for design, daysfor manufacture and days for installation which calculated from thedate on which enter into the site.
二、发包方基础工程完工后，在承包方进场前______天，发包方应向承包方交付土建验收资料，承包方确认施工现场符合施工要求后，由发包方发出进场通知书，进场安装时间以承包方收到进场通知书后第______天起计算。
Employer should, in days prior to contractor’s access to site aftercompletion of foundation project by employer, delivery thematerials of acceptance on civil engineering, and issue Notice ofEntering Site to contractor by which the execution site have beenconfirmed to satisfy the requirements of execution. The time ofentering site for installation shall be calculated on and from theday after contractor receive Notice of Entering Site.
第八条 工程质量 Article Eight Project Quality
一、本工程质量要求达到国家相关规范合格标准。
The quality of this project is required to meet State’s respectednorms and to reach the eligibility criteria.
二、承包方必须严格按照国家有关规范标准要求精心设计，按照施工图纸、施工说明文件进行施工，接受监理工程师及发包方派驻代表的监督。
Contractor should, in accordance with strictly State’s relevantnorms and standards, well-designed and process execution asspecified on the drawings and explanation for execution, andsubject to the surveillance of supervision engineer / siterepresentative on behalf of employer.
第九条 钢结构材料的供应、 验收 Article Nine Provision / Acceptance of SteelMaterials
由承包方提供的主要原材料、标准件，必须按有关规定提供产品质量合格证或进行验收合格后方可用于工程。由发包方提供的主要原材料、标准件，也必须有产品质量合格证方可用于工程。钢构主体工程必须经发包方派驻代表检查、验收签章后，方可进行围护结构的安装。
The main raw materials and standard parts which are supplied bycontractor should pursuant to relevant specification, be providedwith the Product Quality Certification or acceptance before used toproject. The main raw materials and standard parts which aresupplied by employer are also with the Product QualityCertification before used to project. Steel main project should,after through the exam and acceptance with the signature / seal ofemployer’s site representative, be processed with the installationof retaining structure.
第十条 工程价款的支付与结算 Article Ten Payment and Settlement of ProjectCost
工程价款的支付和结算，根据国家有关部门制定的工程价款结算办法,并结合钢结构建筑的特殊情况进行支付与结算。
Payment and settlement of project cost shall, in accordance withthe regulations of engineering cost settlement stipulated byState’s authority concerned, and combined with the particularcircumstances of steel project, be processed.
一、本工程钢梁、钢柱进场三日内，发包方支付合同总价的20％作为工程预付款，计人民币____万元，承包方开始安装。
Employer should, within three days upon the date of steel beams andsteel columns entering into the site, make payment of 20% of totalcontract cost as project’s advance payment which equal to RMB YUANbefore contractor commence the installation.
二、安装竣工并验收合格后的七天内支付合同总价的75％，计人民币_____万元，余款5％，计人民币______万元作为质保金留滞,质保期为一年,待质保期满后三日内付清全部质保金。
Employer shall, within seven days on and after installationcompletion and through acceptance, pay contractor 75% of totalcontract cost, valued sum of RMB YUAN , and remaining 5% whichvalued RMB YUAN as retention money withheld for one year of qualitywarranty, and full retention money shall be released within threedays upon expire of warranty period.
三、如因发包方拖欠工程款而影响工程进度，造成承包方的停工，窝工损失的，应由发包方承担相关经济损失，对延误的工期相应延长。
Provided that if employer’s failure of payment of project costeffect the project progress and result in loss of contractor’s worksuspension and slowdown, on which the responsibilities shall beborn by employer and extension of project term forcontractor.
四、本合同结算方式：银行即期汇票，结算币种为人民币。

第十一条 施工与设计变更 Article Eleven Alteration of Execution andDesign
一、正式的设计施工图纸、说明和有关技术资料，作为施工的有效依据，开工前由发包方组织设计交底和各方会审，任何一方不得擅自修改。
Formal design drawings, interpretation and relevant technicalmaterials are the effective basis of project execution, for which,prior to commencement, employer shall organize design discussionand joint review by the parties concerned, any party shall not makeunilateral alteration.
二、施工中如发现设计的错误或严重不合理的地方，发现方应及时以书面形式通知对方，由提供设计图纸方及时会同有关设计单位研究确定修改意见或变更设计文件，承包方按修改或变更的设计文件进行施工。若因此导致增加费用则由责任方承担，并调整合同造价。
Provided that any discovery of error or substantial unreasonableitem in design, the party which discover should in time givewritten notice to opposite party therewith, and the party by whichthe design drawings submitted should without undue delay, withconcerned design institution, confirm revising opinion of ormodification of design document. Contractor shall make execution inaccordance with the modified design, and the added cost therefore,if any, shall be on the account of the party with obligation, andcontract cost may be adjusted correspondingly.
第十二条 工程验收 Article Twelve Acceptance of Project
一、混凝土基础工程由发包方验收或监理验收合格后在发包方发出《进场开工通知》前交承包方复验。
Concrete foundation project shall, through acceptance of employeror supervision engineer, prior to issuing of Notice of Commencementby employer, delivered to contractor for retesting.
二、钢结构工程验收：按施工图及说明文件、国家现行钢结构工程标准进行验收，验收应在竣工通知发出后五天内开始，逾期不进行验收的，视为验收合格，不影响支付工程款。
Respect to steel structure project: Final acceptance should be madein accordance with drawings, interpretation files and the currentnational standard for steel structure. Acceptance should, withinfive days after issuing Completion Notice, be made, if, fail to doso, the project shall be deemed as acceptance and not effect thepayment of project cost.
第十三条 违约责任 Article Thirteen Responsibilities for Breach
承包方责任：Contractor’s responsibility
一、工程质量不符合设计规定的，负责无偿修理。
Wherever project quality fails to meet the stipulations of design,contractor should make repair in free.
二、因承包方过错不能按合同规定的期限交付使用的，每天按工程总价的万分之五偿付逾期违约金。
Provided that contractor fail to deliver project to use due to thefault of contractor, overdue penalty shall be charged on each delayday by five ten thousandth of total contract cost.
发包方的责任：Employer’s responsibility
一、如果发包方不按合同规定拨付工程进度款，对延付金额按照每天万分之五的违约金偿付给承包方，并允许承包方停工，工期相应顺延。
Provided that employer fail to make progress payment as percontract provisions, deferred amount due to contractor shall becharged with breach penalty by each delay day by five -tenthousandth of the amount payable and allow contractor ‘s suspensionin addition to extension of project term accordingly.
二、工程经验收合格或未经验收提前使用后仍不支付工程款的，违约金按总造价每日万分之十支付违约金。
Should employer still refuse to make payment of project cost afterthrough acceptance or advance use without acceptance, breachpenalty shall be calculated by each day ten – ten thousandth oftotal project cost.

第十四条 纠纷解决办法 Dispute Settlement
如果发生与本合同或其任何附件的效力、解释或执行有关的争议，双方首先应争取通过友好协商解决该争议，如果一方向另一方发出通知开始协商之后的＿＿日内，该争议未以此方式解决，则任何一方可将该争议提交仲裁。
In the event any dispute arises in connection with the validity,interpretation, or implementation of this Contract or any of itsannexes, the Parties shall attempt in the first instance to resolvesuch dispute through friendly consultations. If the dispute is notresolved in this manner within _____ days after the date on whichone Party has served written notice on the other Party for thecommencement of consultations, then either party may refer thedispute to arbitration.
第十五条 附则 Article Fifteen Miscellaneous
一、本合同一式_______份,合同附件_________份。甲已双方各执合同正本______份。与本工程合同有关的施工图纸、招标文件、投标书、中标通知书，履行本合同过程中双方现场代表签署的联系单、指令单、会议纪要等具有合同附件之法律效力。
This contract is make copies of original, with annex copies,parties hereto held
copies of original respectively. Whatever any executing drawings,bidding documents, tender letter, Notice of Acceptance, in additionto, during performance of contract, the contact list, instruction,meeting minutes which are signed by the representatives of partieshereto shall the same validity as contract annex.
二、本合同自双方代表签字，加盖双方公章或合同专用章后成立，收到定金后合同即生效；在工程竣工验收符合要求，保修期满，结算工程款支付完毕后合同终止。
This contract shall, on and from signature of the representativesof parties hereto, be made establishment and shall become effectiveupon receipt of deposit, and shall cease its validity on and afteracceptance in conform with the requirements, expire of warrantyperiod and full payment of project cost.

Fixing and calibration of anchor bolt for steel structure
钢结构地脚螺栓的固定与校正技术要求
Location of anchor bolt is the first key in the steel constructionof this engineering, and shall be specially take care. The locationshall be in time and correct to avoid delaying the constructionperiod. After give out axis and frame before installing theembedded parts, cooperate the installing personnel to carry outrechecking for two times when the installation fixing and concretepouring almost are formed, and adjust the position and elevation toensure no risk at all.
柱脚螺栓的的精确定位是本工程钢结构施工的第一重点，应特别予以注意。定位要求及时、准确，避免延误工期。在预埋件安装前给出轴线、边框位置后，还要再配合安装人员，在安装固定和砼浇筑即将成型时进行两次复核，及时调整位置、标高，保证万无一失。
The embedding works of anchor bolt parts are responsible by specialpersonnel, set with a special team, included one foreman, onemeasurer, two welders, two bar placer, and two woodworkers, to beresponsible for all embedding works and in charge by theforemen.
预埋件预留工作安排专人负责，设一个专门小组，包括1名工长、1名测量员、2名电焊工、2名钢筋工和2名木工，负责全部预埋工作，并由工长统一负责。
Anchor bolts shall be processed, piled up in classification, andmarked as per the requirements in the drawing beforehand, and betransported to the embedded position in time when the constructionreaches the position at where the parts are used.

Position of anchor bolt is measured from the axis and bounced outthe centralized cross line by measurer as per the designedrequirements, and is placed per the line in setting. Due to thecorner iron bracket that fixes the bolt is suspended and leaves adistance from the bottom, shall extend the vertical corner iron upto the upper surface of foundation slab, or increase corner ironbracket to support the bracket of bolt. When positioning, all shallbe measured from the axis and must not from the sideline oftemplate to prevent the deflection of embedded parts resulted fromthe incorrect template position
预埋件位置由测量员按设计要求，从轴线引测，弹出中心十字线，设置时按线安放。由于固定螺栓的角铁支架悬空、不到底，应将竖向角铁加长到基础底板上表面，或增加角铁支架来支撑螺栓支架。定位时应当全部由轴线引测，不得由模板边线引测，防止因模板位置不准导致埋件偏移。
For ensuring the embedded parts fixed securely, may weld them onthe structural reinforcement by welder (But shall pay attention tonot damage the force carrying reinforcement) to fix its relativeposition with the template for preventing the inner contraction ofembedded parts deflects from the template and embeds into theconcrete during concrete pouring. All the uppers of embedded boltsmust be drawn through by reinforcement, or steel tube, and corneriron, etc., to ensure them not moved during concrete pouring.
为保证埋件固定牢靠，可用焊机将其焊在结构钢筋上(但应注意不得损伤受力钢筋)，固定其与模板的相对位置，防止在砼浇筑时埋件内缩偏离模板而埋入砼中。预埋螺栓上部必须全部用钢筋或钢管、角铁等全部拉通，确保在砼浇筑过程中不位移。

When reinforce the embedded parts, mayutilize the existing reinforcement framework, but must not affectthe structural requirements of reinforcement engineering, andmeanwhile the reinforcing method shall be tidy and beautiful aspossible.
