1,签发提单授权书

As requested I hereby authorize you to sign the original bills of lading on my behalf strictly in conformity with the Mate's Receipt. However you must always get the owner's written approval before signing the bills of lading and release the same to the parties concerned.

MV Hebei Hope, under my command, will load the cargo of about 50,000 MTS maize in bulk in DaLian pursuant to the charter party dated 25th October 2002.I hereby declare that my vessel's DWCC for this cargo could be 52,500 MTS in accordance with the vessel's capacity and the stowage factor of (×××) provided by the charterers in the charter party. Please note and arrange accordingly.

2、宣载通知可以电传或信函发出,具体货量应于协商。

3、船长签字一定要附带日期。船上所有工作人员都要养成“只要需要签字就签上日期”的习惯。这一点非常重要。

注:1、备妥通知书递交的两个条件是抵达船舶(arrived ship) 和事实备妥(physically ready in all respects)。

2、在需要递交第二份备妥通知书的情况下(如:公司有指示、验舱一次未通过等),应在第二份备妥通知书上加注“WITHOUT PREJUDICE TO HET ORIGINAL”,即不影响第一份的效力。

4,Protest for Dead Freight

I, the master of MV Hebei Progress, declared my vessel’s DWCC 49,500 metric tons for the cargo of coke in bulk to be loaded at Xingang under the current voyage on the basis of stowage factor 65 (pursuant to the governing charter party)/(provided by Charterers).

However, upon completion of loading at XXX on XXX, it came out that only XXX metric tons had been loaded onboard as per draft survey, XXX metric tons less than my foregoing declared DWCC. (No more cargo was available and my vessel was arranged to sail at XXX on XXX although my vessel still had enough capacity to receive the balance cargo.)

In view of the above facts, I, on behalf of my owners and XXXX, herby tender my protest against parties concerned, reserving rights to claim against them for the dead freight and other loss whatsoever so caused.

The vessel sailed from Shanghai on March 6, 1999 and bound for Rotterdam for discharge the cargo of various minerals on board.

At about 0300L on 26th March 2002, while the 2nd engineer was on duty he heard an abnormal sound of the No 2 generator and after a few seconds smoke was found emitted from the crankcase and the engine was stopped immediately. Upon inspection by the crew,the damages sustained by the no. 2 generator were as follows:

1.Nos.1,2 and 4 main bearing shells were found severely wiped.

2.Nos.3 and 4 crank pin bearing shells were found severely wiped.

3.Nos.3 and 4 crank pins had severely scored.

Although the exact reason for the damages could not be ascertained at the moment, it might be due to water ingress since the oil sump level had increased and water was found leaking from no.2 liner. To repair the generator, the engine must be completely dismantled for renewal of the crankshaft.

注:1、海事声明是在事故发生后,未发现具体损坏项目前,为了保留以后索赔权利时使用的。也用于遇到大风浪后争取免除船方责任,主要是应对收发货人。此项声明必须在船到港后24小时内做出,或者在开舱卸货前起草好海事声明并得到签证。

2、事故报告是在事故(多为机损和货损事故)发生后已造成属于保险范围内具体损失时使用,专门用于对保险公司的报案及索赔用。对于我公司的船舶来说,目前可以按此格式用中文来书写事故报告。
