以普通词汇翻译术语—— “优先购买权”

第一百零一条  按份共有人可以转让其享有的共有的不动产或者动产份额。其他共有人在同等条件下享有优先购买的权利。

Article 101  A co-owner who shares ownership of the immovables or movables shall have the right to transfer his own share. The other co-owners shall have the priority to purchase under equal conditions.

用“the priority to purchase”来翻译“优先购买权”，其实是用普通词汇解释术语，而不知道法律英语中有“preemption”这个专门的术语。《元照英美法词典》对“preemption”的第一个解释：“<美> 优先购买权；先买权；（通过抢先占用等取得的）公共土地优先购买权。”（薛波，2003: 1077）根据Black’s Law Dictionary对“preemption”的解释：“1. The right to buy before others. 2. The purchase of something under this right. 3. An earlier seizure or appropriation. 4. The occupation of public land so as to establish a preemptive title.”(Garner, 2009: 1297) 对“right of preemption”的解释是：“A potential buyer’s contractual right to have the first opportunity to buy, at a specified price, if the seller chooses to sell within the contracted period.”(Garner, 2009: 1439)
