谈到“不可抗力”这一法律术语，我们需要了解的大概有3个词或词组，分别是英文：act of God；法文：Force Majeure，它们通常均被翻译为“不可抗力”；还有一个相关的英文单词叫contingency，本来指“突发事件，意外事件”，但在实践应用中，也常与不可抗力条款混用。
在上面几个法律术语当中，Force Majeure的字面意思是“超级力量”，通常，它的涵义要广于英文“act of God”，后者指“不受人力控制，也无人类参与，纯由自然力单独作用造成”。而Force Manure则“不仅包括自然力，还包括人为的力量（如暴乱、罢工、政府干预、战争行为等）'。不可抗力条款（Force Majeure Clause）有时又被称为“意外事件条款”（Contingency Clause）。Contingency的运用广泛，除天灾外也包括人祸，如战争（war）、封锁（blockage）、革命（revolution）、叛乱（insurrection）、民众骚扰（civil commotions）、暴动（riots）、动员（mobilization）、罢工（strikes）、工厂封锁（lockouts）、天灾（act of God）、恶劣气候（severe weather）、疫病（plague）或其他疾病（other epidemic）、货物遭火灾或水灾（destruction of goods by fire or flood）等。

Action，Litigation，Suit，Proceedings和Procedure区别 上述单词均可表示“诉讼”。action，litigation和proceedings都为一般术语，可指各种诉讼案件。但action则逐渐演变，现在多用于指民事诉讼，因而有Action is a mode of proceeding的说法。如果要表示刑事诉讼，多应在action前面加criminal予以区分。litigation除了指诉讼之外，还有诉讼程序的含义，如Civil Litigation便为《民事诉讼程序》，是一本有关英国民事诉讼程序的专著。suit是lawsuit的简略形式，主要用于指民事诉讼。传统上，action和suit之间的差异在于action指普通法法院的诉讼，其程序到法院判决（judgment）即终止；而suit则为衡平法法院的用语，其程序包括判决和执行（judgment and execution）。在美国，这两个单词的差异因衡平法法院和普通法法院的合并已经不再存在。procedure主要是指诉讼程序，如criminal procedure code（刑事诉讼法典）等。 |
