【日常】一场由一名中国船员引发的……

在一个风和日丽的早上

一条在Jaigarh卸货的船

定了一票印度内贸的货

装钢材从Hazira到Paradip


装钢材也没什么稀奇的,印度内贸也是很常见的航线,船长照例给印度的代理提供各种船舶证书、信息以及船员名单(话说船到印度要准备的靠港信息和文件真是巨多无比啊!)。


结果问题来了,船上有一名中国船员,被D.G Shipping (Director General of Shipping是印度的政府部门)要求security clearance,如果拿不到clearance,船就没法去Haldia。


得知消息的我,真是无语加无语加一脸懵逼……

咨询过了代理,代理说也不是每条做印度内贸的船都会被DG Shipping这样要求,但是船运气好被选中那只能认了。若问解决办法,那只有两个:一是把中国船员换下去;二是按照流程去做security clearance。


听到这个,我立刻马上举手选一啊!

得知Jaigarh太偏远-->连immigration都没有-->换不了船员

那我选二呢……


The procedure and costs for obtaining D.G. LICENCE and conversion /Reversion of vessel from Foreign to Coastal Run/ Coastal to Foreign Run:-

 

1.Coastal Trading License – Only Indian Charterers are issued license / authorized to Charter foreign flag vessel for Domestic Trade. It takes about 3-5 working days for obtaining Coastal trading license. However, we give below detail procedure of obtaining Coastal Trading License:

 

D.G. SHIPPING PROCEDURES / REQUIREMENTS FOR CHARTERING OF FOREIGN FLAG VESSELS. 

 

1. THE CHARTERERS TO BE REGISTERED WITH I.N.S.A. (Indian National Ship owners Association) 

2. THE CHARTERERS TO BE REGISTERED WITH D.G. SHIPPING (Director General of Shipping) FOR ON-LINE SUBMISSION OF APPLICATIONS. 

3. THE CHARTERERS TO FILE AN ON-LINE APPLICATION TO D.G. SHIPPING FOR CHARTERING THE VESSEL, CALCULATING 3 CLEARING WORKING DAYS. (NOTE: TO BE ON THE SAFE SIDE THE NO. OF CLEAR WORKING DAYS TO BE MAINTAINED AS 5.)

4. THE ON-LINE APPLICATION TO BE FOLLOWED WITH A HARD COPY OF THE APPLICATION ENCLOSING ALL REQUIRED DOCUMENTS AND CERTIFICATES

 

THE FEES PAYABLE IS AS FOLLOWS:-

 

1. INSA REGISTRATION IS FREE OF CHARGE.

 

2. THE ON-LINE APPLICATION  TO BE FOLLOWED WITH A HARD COPY OF THE APPLICATION ENCLOSING ALL REQUIRED DOCUMENTS AND CERTIFICATES ALONG WITH A DEMAND DRAFT / PAY ORDER FOR RS. 40,000.00 PAYABLE TO DIRECTORATE GENERAL OF SHIPPING, MUMBAI FOR A MINIMUM CHARTER PERIOD OF 30 DAYS AND FOR MORE THAN 30 DAYS, RS. 2,000.00P PER DAY EXTRA.

 

3. SIMULTANEOUSLY AN APPLICATION (ON PRESCRIBED FORM COSTING RS.200.00) IS TO BE MADE FOR A SPECIFIED PERIOD LICENCE ALONG WITH A DEMAND DRAFT / PAY ORDER FOR RS. 20,000.00P PAYABLE TO DIRECTORATE GENERAL OF SHIPPING, MUMBAI. 


4. THERE ARE LATE APPLICATION CHARGES TOO.

1. VESSEL’S Q-88 (VERSION2)

2. VESSEL’S CERTIFICATES. ALL SHOULD BE VALID AND CURRENT:

A. INTERNATIONAL TONNAGE CERTIFICATE

B. INTERNATIONAL SHIP SECURITY CERTIFICATE WITH ADDENDUM

C. CARGO SHIP SAFETY RADIO CERTIFICATE

D. CARGO SHIP SAFETY EQUIPMENT CERTIFICATE.

E. CARGO SHIP SAFETY CONSTRUCTION CERTIFICATE

F. INTERNATIONAL OIL POLLUTION PREVENTION CERTIFICATE ALONG WITH FORM ‘B’.

G. INTERNATIONAL LOAD LINE CERTIFICATE

H. CERTIFICATE OF CLASS.

I. SAFETY MANAGEMENT CERTIFICATE

J. MINIMUM SAFE MANNING DOCUMENT/CERTIFICATE.

K. INTERNATIONAL SEWAGE POLLUTION PREVENTION CERTIFICATE

L. INTERNATIONAL AIR POLLUTION PREVENTION CERTIFICATE

M. SPS CODE COMPLIANCE

N. MODU SAFETY CERTIFICATE

O. CERTIFICATE OF FITNESS TO CARRY CHEMICALS (NLS CERTIFICATE)

P. HSC CERTIFICATE

Q. LAST PSC REPORT IN INDIA

3. P & I INSURANCE COVER POLICY

4. DOCUMENT OF COMPLIANCE

5. CERTIFICATE OF CHANGE OF NAME AND CLASS IF APPLICABLE.

6. SHIP’S CERTIFICATE OF REGISTRY

7. CAS REVIEW RECORD – NOTE APPLICABLE FOR THIS VESSEL

8. STATEMENT OF COMPLIANCE FOR CONDITION ASSESSMENT SCHEME (CAS). NOT APPLICABLE FOR THIS VESSEL

9. CONDITION ASSESSMENT PROGRAMME DECLARATION. (IF APPLICABLE OR AVAILABLE). NOT APPLICABLE FOR THIS VESSEL.

10. COPY OF CHARTER PARTY AGREEMENT.


是不是看到上面这篇幅长度就够了(其实我并没有全部贴过来),根本不想知道程序是哪些,只想知道花多少钱,用多久的时间能拿到DG License,以及是不是花了钱和时间一定能办成事。


然而代理却说是否能拿到不一定!


除了绝望,我想不到还有别的什么词能够形容我此时此刻的心情了。

多亏下个装港是印西的港口,船还有机会先靠下Mumbai把船员放下再前往Hazira。

然而,去Mumbai虽然可以解决中国船员下船的问题,费用并不便宜啊。Port dues, pilotage, launch这些七七八八加一起,就为了换下一名中国船员港使费就要花大概6000美金!这够船员一个月工资了吧!再加上送船员下船的交通费(比如机票)等,简直让人头大。但是,为了解决问题,硬着头皮也要换啊!

小结

做印度内贸的货,千万记得在定船之前看下船员名单,如果有中国籍船员,那么最好提前换下去,或者干脆不要用这条船了,省得以后给自己麻烦。


此外,关于外籍船旗的船做印度内贸航线,也是有要求的,即一年内跑内贸航次的时间不能超过30天。如果超过30天小于90天,则需要船上至少有三分之一的船员是印度籍船员。如果超过90天,则要求船上一半的船员都是印度籍船员。

思考

在time charter中,如果定船的时候,租家没有问船东要船员名单,等到clean fixed之后由于船上有中国籍船员导致船无法做内贸的航次,谁来负责?通过换掉船员的方式继续来做这个生意,所有换船员的费用,谁来承担?有CP条款可以依据吗?
