香港PSCO:这几个滞留依据,不好找!

2019年九月份,香港PSCO滞留了3艘船舶,仔细盘点这批缺陷,会发现有几项,PSCO在船上经常遇到,但是以此为依据滞留船舶的时候,因为依据不好找,却没底,不知道应该使用哪项公约条款为依据。

由于PSC检查注重依据,依据错误,会留下隐患,比如被船长质问并要求解释、甚至被复议,一些年轻的朋友往往会因为此,而错失良机!当然这对船东而言,可能是好事情。

本期PSCReady(微信公众号:PSCReady)分析下这几个滞留缺陷,试图找到公约中不太容易找到依据。

滞留缺陷一

10136  CHIEF ENGINEER, FIRST ENGINEER DO NOT UNDERSTAND ANY ENGLISH. ALL INSTRUCTION FROM CAPTAIN, DECK DEPARTMENT IS TRANSFER TO MOTOR MAN INSTEAD OF CHIEF ENGINEER AND FIRST ENGINEER. COMMUNICATION BETWEEN DECK AND ENGINE DEPARTMENT TOTALLY FAILURE

老轨、大管不懂英文,船长和甲板部向机工下达指令,而不是向老轨和大管下达指令。甲板和机舱的沟通联系失效。

这很明显是一个小公司为了降低成本,雇佣缅甸等地低工资的干部船员,这种船风险性很高,建议各PSCO重点关注,重点打击。

这项缺陷的依据可以使用船舶配员和船舶的工作语言,缺陷依据位于:SOLAS 2012年修正案第 V章第14条:船舶配员STCW公约

1. The Contracting Governments undertake, each for its national ships, to maintain, or, if it is necessary, to adopt, measures for the purpose of ensuring that, from the point of view of safety of life at sea, all ships shall be sufficiently and efficiently manned 从海上人命安全观点出发,各缔约国政府承担义务,对其本国的每艘船舶应经常保持,或在必要时采取措施来保证所有船舶配备足够数量和胜任的船员。

3.On all ships, to ensure effective crew performance in safety matters, a working language shall be established and recorded in the ship's log-book. The company, as defined in regulation IX/1, or the master, as appropriate, shall determine the appropriate working language. Each seafarer shall be required to understand and, where appropriate, give orders and instructions and to report back in that language. If the working language is not an official language of the State whose flag the ship is entitled to fly, all plans and lists required to be posted shall include a translation into the working language.(在所有船舶上,为了保证船员在安全事务上的有效的操作,应建立一种工作语言并将其记录在船舶航海日志上。符合本公约IX/1条定义的公司或船长(合适者)应确定适当的工作语言。应要求每个船能懂得这种语言,并在合适时使用这种语言下达指令和包括应答。如果工作语言不是船旗国的官方语言则所有需张贴的图纸和图表应翻译成工作语言。

4.  On ships to which chapter I applies, English shall be used on the bridge as the working language for bridge-to-bridge and bridge-to-shore safety communications as well as for communications on board between the pilot and bridge watchkeeping personnel* , unless those directly involved in the communication speak a common language other than English.(在本公约第I章适用的船舶上,英语应被用作驾驶台的工作语言,以进行驾驶台对驾驶台、驾台对岸的安全通信以及用于引航员和驾驶台值班人员之间在船上进行通信,除非直接参与通信的人都讲英语以外的一种共同英语。

船与岸,船员之间,必要的沟通应使用工作语言,很重要,不能沟通,直接影响安全,PSCReady(微信公众号:PSCReady)呼吁各位大佬,不要为了省费用,雇佣不合格的船员。这哪里是省钱,是把人命视为草芥!

滞留缺陷二

02115 TWO GENERATOR INSTALLED ON DECK DO NOT HAVE ANY CERTIFICATE. GENERATORS JUST INSTALLED SEPT. 2019, EIAPP CAN NOT BE SHOWN

这项缺陷的意思是:20199月,新安装的两台发电机,没有任何证书,当然EIAPP证书也是没有的。

对于新安装上船的发电机,依据MARPOL附则VI13条,130KW功率以上的柴油机:

200011日至201111日要满足Tier I

201111日之后要满足Tier II

201611日之后,北美排放控制区内要使用Tire III202111日之后,波罗的海和北海排放控制区内要使用Tire III

柴油机重新安装,不是随意更换就满足要求,不仅仅是要取得EIAPP证书。需要船级社重新检验,重新签发设备安全证书。否则,SOLAS公约第一章第十一条:检验后状况的维持,便完全不满足,这是根本性错误,希望各位船东大佬,不要那么随意,船上的设备不是自己家的,买个空调随便换了就行,船舶检验是有规矩和程序的。给船级社留口饭吃!

滞留缺陷三

14108  OILY WATER SEPARATOR ALARM TESTING WAS NOT ABLE TO SHOWN TO PSCO. NO ANY AUDIABLE SOUND ALARM

船员不能向PSCO展示油水分离器测试报警,测试期间,没有声报警。

这个小缺陷,前期做了较多的分析,油水分离器15ppm报警装置在测试和归零的时候应提供报警,不少船舶设计有些缺陷,已经在整改了。

这款油水分离器摊上事了……滞留罚款?

滞留缺陷四

MARINE GAS OIL BUNKER OIL SPILL DURING PSCO INSPECTION. ESTIMATE 200L OF MGO SPILLED FROM UPPER DECK MGO VENTILATOR AND OVER FLOW TO DECK.

PSCO检查期间,发现大约200L的燃油从透气孔溢出到甲板。这项缺陷依据不太好找!

这一项显然是加油操作期间,人员监控不到位,导致燃油溢出,从此也可以观察到船上的责任心很差,首先,违反了MARPOL附则I的要求,根据附则I11条,一旦PSCO发现船舶加油操作不熟悉,可以立即开展检查。

依据是:A ship when in a port or an offshore terminal of another Party is subject to inspection by officers duly authorized by such Party concerning operational requirements under this Annex, where there are clear grounds for believing that the master or crew are not familiar with essential shipboard procedures relating to the prevention of pollution by oil.(当船舶停靠在另一缔约国港口或近海装卸站时,如有明显理由认为该船船长或船员不熟悉船上主要的防止油污染程序,该船应接受该缔约国正式授权官员根据本附则进行的有关操作要求的检查。)

这项缺陷,随着检查的深入,还可以紧跟着一个ISM缺陷,使用ISM CodeA部分第7条:DEVELOPMENT OF PLANS FOR SHIPBOARD OPERATIONS作为缺陷依据。

其他缺陷比较容易理解,不做解释了,各位可以随意看,就这样。
