Submit relevant information to Party B within days from the date of signing the contract. 2、自接到乙方编制的技术设计书之日起 日内完成技术设计书的审定工作，并提出书面审定意见。2. Complete the verification of the technical designs and submit written verification opinions within days from the date of receiving the technical designs prepared by Party B,. 3、应当保证乙方的测绘队伍顺利进入现场工作，并对乙方进场人员的工作、生活提供必要的条件。 3. Should ensured the Party B’s team of surveying and mapping enter the site smoothly and provide necessary or desirable conditions of the work and life for them. 4、甲方保证工程款按时到位，以保证工程的顺利进行。4. Party A guarantees the project funds in place on time to ensure the smooth progress of the project. 5、允许乙方内部使用执行本合同所生产的测绘成果。5. Allow and permit Party B internally use the surveying and mapping results which produced by implementation of the present contract. 第六条 乙方的义务 Article 6 Party B’s obligations 1、自收到甲方的有关材料之日起 日内，根据甲方的有关资料和本合同的技术要求，完成技术设计书的编制，并交甲方审定。 1. Within days from the date upon receipt of Party A's relevant data and documents, make completion of preparation of the technical design document in accordance with Party A's relevant data and documents and the technical requirements hereof and submit the same to Party A for approval. 2、自收到甲方对技术设计书同意实施的审定意见之日起 日内组织测绘队伍进场作业。 2. Organize the surveying and mapping team access the site for operation within days from the date upon receipt of Party A's approval opinion on implementation of the technical design document. 3、乙方应当根据技术设计书要求确保测绘项目如期完成。 3. Party B shall ensure the surveying and mapping project being completed on schedule in accordance with the requirements of the technical design document. 4、允许甲方内部使用乙方为执行本合同所提供的属乙方所有的测绘成果。 4. Party A is allowed to internally use the achievements and results of surveying and mapping provided by Party B for the execution of this contract. 5、未经甲方允许，乙方不得将本合同标的的全部或部分转包给第三方。 5. Without Party A’s permission, Party B shall not subcontract whole or any part of the present contract to third party. 第七条 测绘项目完成工期Article 7 Completion term of the surveying and mapping projects 第八条 测绘成果验收 Article 8 Acceptance of surveying and mapping results 乙方应当于工程完工之日起 日内书面通知甲方验收，甲方应当自接到完工通知之日起 日内，组织有关专家，依据本合同约定使用的技术标准和技术要求，对乙方所完工的测绘工程完成验收，并出具测绘成果验收报告书。 对乙方所提供的测绘成果的质量有争议的，由测区所在地的省级测绘产品质量监督检验站裁决。其费用由败诉方承担。 Party B shall notify Party A in writing of acceptance within day of completion of the project. Party A shall, within day of receiving the notice of completion, organize relevant experts, in accordance with the technical standards and technical requirements stipulated herein, complete the acceptance of the surveying and mapping project completed by Party B, and issue the acceptance report of surveying and mapping results. Any dispute over the quality of surveying and mapping achievements provided by Party B shall be appealed the provincial supervision and inspection station of surveying and mapping product quality in the location of the survey area for judgment and the charges thereof shall be borne by the losing party. 第九条 测绘成果权属 Article 9 Ownership of surveying and mapping results 对乙方测绘成果的所有权、使用权和著作权归属的约定：The agreement on ownership, right of use and copyright ownership of Party B's achievements of surveying and mapping: 第十一条 交付测绘成果 Article 11 Submission of surveying achievements 1、自测绘工程费全部结清之日起 日内，乙方根据技术设计书的要求向甲方交付全部测绘成果。 1. Party B shall, within days from the date of full settlement of surveying and mapping works, submit all achievements and results of surveying and mapping to Party A as the requirements of the Technical Design document. 乙方向甲方交付全部测绘成果表。 Party B shall submits to Party A all achievements and results of surveying and mapping. 乙方向甲方交付约定的测绘成果 份。甲方如需增加测绘成果份数，需另行向乙方支付每份工本费 元。 Party B shall submit to Party A copies of the agreed achievements and results of surveying and mapping. If Party A needs more copies thereof, Party A shall pay yuan of separate cost of each copy to Party B. 第十二条 甲方违约责任 Article 12 Liability for Party A’s breach of contract 1、合同签订后，乙方未进入现场工作前，由于甲方工程停止而终止合同的，甲方无权请求返还定金。双方没有约定定金的，偿付乙方预算工程费的30%，人民币 元；乙方已进入现场工作，甲方应按完成的实际工作量支付工程价款，并按预算工程费的 %（ 元）向乙方偿付违约金。 1. On time after the signing of the contract and Party B do not enter the site for operation, Party A has no right to request return of the deposit if Party A terminates the contract due to termination of its project. If the parties fail to agree on a deposit, shall pay Party B 30% of the project budget costs equal to RMB; Provided that if Party B has entered the site work, Party A shall pay the project price subject to the actual workload completed, and shall pay Party B a penalty for breach of contract at % ( yuan) of the project budget costs. 2、乙方进场后，甲方未给乙方提供必要的工作、生活条件而造成停窝工时，甲方应支付给乙方停窝工费，停窝工费按合同约定的平均工日产值（ 元/日）计算，同时工期顺延。 2. Provided that if, subsequent to Party B enters the site, Party A fails to provide Party B with the necessary working and living conditions, which results in the suspension of work for which Party A shall disburse or make payments of to Party B’s suspension of work, which shall be calculated according to the average daily output value ( yuan / day) stipulated in the contract, and the construction period shall be postponed. |
